Businesses File Suit against Fizzy Drink Ban in NYC

It seems that it would not be an easy task for New York activists, who want to bring a ban on extra large sugary drinks. It is now said that some of the business companies have filed a law suit against the Board of Health, New York City.

According to the law suit, the board does not have authorities to levy a ban on extra large sugary drinks. One among the businesses is the American Beverage Association. The association with other companies was of the view that the board does not have this much power that it can implement a ban on sugary drinks larger than 16 ounces.

They further affirmed that though the board can devise such policies, they have no power to enact the same. The lawsuit has further unveiled that the ban would severely harm other small businesses. "The Board of Health’s decision nonetheless to ban certain sizes of sweetened beverages in certain outlets, imposed by executive fiat, usurps the role of the City Council”, read the suit. On the other hand, the Board of Health was not available for the comment. It now has to be seen that whether the board will be able to get the ban active in the city or not.
