Court’s recent Ruling over Ruby Natural Gas Pipeline

Monday's ruling from a court has not at all favored the two federal agencies, which have been stated violating the Endangered Species Act.

The judge's panel has suggested both the involved agencies to reconsider the additional protection for the Lahontan cutthroat trout along with all the other rare fish that could be adversely affected by the 700-mile Ruby pipeline that is carrying natural gas from Wyoming, through Utah and Nevada into southern Oregon.

The three-judge panel of the 9th U. S. Circuit Court of Appeals said in its ruling that both the U. S. Fish and Wildlife Service and Bureau of Land Management have broke the law as they have not properly examined the potential harm that can be caused to the fish due to the pumping of more than 300 million gallons of water from beneath the ground in Oregon and Nevada regarding the project that has already completed two years ago.

The appellate court also said that the government of the region has illegally relied on the project that hasn't been funded following the facts that there are strict needs of enough protection plans to be in place first for the cutthroat trout and other fish in hundreds of rivers and streams in the four states.

"We wish the Ruby pipeline had never been built, but since it was, it's crucial that everything possible is done to minimize harm to the endangered fish that live along its route", said Ms. Noah Greenwald, endangered species director for the Center for Biological Diversity, which sued to protect the fish along with Defenders of Wildlife.
